Thank you for allowing Advanced Concepts to produce materials for your company. We will strive to give you professional service in every area of endeavor. Since Advanced Concepts is a media production company, it is important that you understand the legalities as they pertain to our line of work. As the paying customer, it is important that you understand exactly what you are paying for, and what you will (and will not) own when the work is finished. This memo addresses the three primary areas of work that deal with ownership and copyrighted material, and a few rules you need to know.

Rule number One: At Advanced Concepts, we will not incorporate any copyrighted works into your project unless you can provide us with a copyright and/or broadcast release. This includes photographs, music or published materials. It is your responsibility to obtain a release from the owner if you wish to have protected materials included in your work project. We do not make exceptions to this rule.

Rule number Two: Once the work is completed, Advanced Concepts will retain ownership and copyrights to all work until all outstanding invoices have been paid. Once all outstanding invoices are paid, the customer will have only RESTRICTED USE of the materials until such time that the customer pays for full unrestricted use and ownership. Restrictions of Use and prices for full release are listed below:

Photography:

Personal or Non Commercial Clients: These photographs include family portraits, wedding photography, casual photos, etc. This category of photography includes Full Copyright Release in the contracted price once the invoice is paid in full. The client is not required to pay any additional fees in exchange for full ownership and copyright release.

Commercial Photography: This category of photography includes industrial, service, corporate or development photographs. Once all outstanding invoices are paid, the client has unrestricted use of the photographs, both digital and print, without any additional fees. However, ownership and copyright will remain the property of Advanced Concepts. The client may purchase full ownership and copyright release for a fee of $50.00 per photograph.

Websites: Once the client approves the website and it is ready to be posted for viewing (either public or private) the client has the option of having Advanced Concepts host and maintain the website, or the client may purchase full release and ownership of the site and perform these services through a third party. If the client chooses to have Advanced Concepts provide hosting and maintenance services, Advanced Concepts shall retain full ownership and copyright over the site while acting on behalf of the client to display the website. If the customer chooses to contract with a hosting and maintenance source outside of Advanced Concepts, a fee of $100.00 per web page must be paid. This fee does not apply to linked pages outside of the client website. Upon payment of said fee, Advanced Concepts will provide a digital copy of the website to the client, including website images, text, database documents and a current copy of the full website.

Video Production: Once completed and all outstanding invoices are paid, the client will receive Full Ownership and Copyright. The fees for copyright and usage are included in the production cost of the video. This includes broadcast materials for television, DVD, CD and computer based video material.

Please note: In each of these cases, the client agrees to provide clearly visible production credit to Advanced Concepts for having created the work. Advanced Concepts retains the right to use portions of any materials our company has produced for promotional or advertising purposes (i.e. to show samples of our work to potential clients). Restricted or classified materials, and materials of a competition sensitive nature are of course excluded from this promotional use.
